We supported a client, who had needed assistance with negotiating an extension to the time period in which to vacate the property. This was a typical issue, as many tenants could not find a property within the standard 30 days’ notice at the end of a fixed term lease.
The client was unemployed, in search of work and on Centrelink jobseeker payments. They had a 14-year old child and were a single parent. We provided the client with advice regarding the termination of their tenancy, which had already proceeded to an application to the Magistrates Court for termination and possession. This advice included explaining the power of Magistrates to extend the time to vacate or make any other orders as they see fit.
Using this advice, the client successfully requested an additional 30 days to vacate and was able to vacate and move in with family during this time.
